Terms of Service

These Terms of Service ("Terms") govern your access to and use of HostScore (the "Service"), operated by Euphoric LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What HostScore is

HostScore analyzes short-term rental listing photos and nearby comparable listings to produce informational estimates — including an estimated average daily rate (ADR), amenity and aesthetic premiums, and styling suggestions. All outputs are estimates for informational purposes only. They are not guarantees of rental income, occupancy, or performance, and are not financial, investment, tax, or legal advice. You are solely responsible for how you price and operate your listings.

2. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it current.

3. Plans, billing, and cancellation

• Paid plans are billed on a recurring monthly basis through our payment processor, Stripe. By subscribing, you authorize recurring charges until you cancel.
• You can cancel at any time from your account settings. Cancellation stops future renewals; your plan remains active through the end of the current billing period.
• Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods or unused features.
• We may change plan pricing or features with reasonable notice. Changes take effect on your next billing cycle.

4. Acceptable use

• Only upload photos and property information that you own or have the right to use. Do not upload content that infringes others' rights or that is unlawful.
• Do not misuse the Service: no scraping, reverse engineering, automated bulk access, attempts to circumvent usage limits, or interference with the Service's operation or security.
• Do not use the Service to violate any applicable law or any third-party platform's terms (for example, the terms of the platforms where you list your rentals).

5. Your content and third-party processing

You retain ownership of the photos and property details you submit ("Your Content"). You grant us a limited license to process Your Content to provide the Service — which includes sending photos to our third-party AI provider (Anthropic) for analysis and storing them with our infrastructure providers. 6. Third-party data

Comparable listing data is provided by third parties (including AirROI) and is offered "as is." We do not control and are not responsible for the accuracy, completeness, or availability of third-party data, and it may change or become unavailable.

7. Intellectual property

The Service, including its software, design, and content (excluding Your Content), is owned by us and our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

8. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that estimates will be accurate or that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenue, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that risks harm to us, other users, or third parties.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or in the app). Your continued use of the Service after changes take effect constitutes acceptance.

12. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any disputes will be resolved in the state or federal courts located in Texas.
